We recently wrote to the Northampton Department of Public Works requesting an abatement for the storm water fee we have been assessed. Our property is on Turkey Hill Road in Ward 6.
All of the runoff from our property flows down Turkey Hill Road and eventually into the Manhan River and never enters the stormwater treatment area for the city of Northampton.
From the DPW we learned that if we build a “rainwater garden” we can receive a 25 percent rebate. We were also informed that we will continue to be assessed the highest “fee” of nearly $250 per year because of the extent of “impermeable” areas on our property.
We are happy to pay a fee for a service and do so for many other city services. For such fees we receive a service, but we can’t say the same for our “stormwater” fee.
Other state courts have found stormwater fees to be illegal, because property owners are not allowed to vote on them. In Michigan the Court of Appeals has ruled the fees illegal and has even mandated refunds.
According to the Matrix Consulting Group, which reported to the city last January, the DPW has consistently “over estimated” expenses and unspent money has been going into a “free cash” account. (For more on this issue see Mike Kirby’s post on kirbyontheloose.com.)
So what is it, a fee or a tax? If it is a fee, then Ward 6 and the Meadows merit abatements. It is time for the City Council to amend the ordinance.
