BELCHERTOWN – Police say a 20-year-old man who allegedly robbed a Pizza Hut delivery driver at gunpoint Tuesday night was using a BB gun.
Aaron Dakota Fogg, of Belchertown, was arrested by Belchertown Police at his home Thursday at around 7:15 p.m.
He pleaded not guilty in Eastern Hampshire District Court Friday morning to charges of robbery while armed and masked and assault to rob while armed with a firearm.
Police said Fogg took $5 from the driver, Brogan Mahan, which was all the money he had on him at the time of the incident.
Belchertown Police received a report of the robbery at around 9:30 p.m. Tuesday.
A pizza was ordered for 5 Lake Drive in Belchertown and when Mahan arrived he noticed someone standing along a nearby tree line, Officer Michael Beaupre wrote in court documents.
Mahan got out of the car, assuming the person had ordered the pizza, and was approached by Fogg, according to court documents. Fogg asked the driver if he had change for a $20 and when Mahan responded he did, Fogg pulled out a firearm from his waistband and aimed it at the side of the driver’s head, Beaupre wrote.
“The suspect then said ‘give me what you have or I’ll hit you,’” Beaupre wrote in his report.
Two days after the incident, Fogg’s brother Dalon Spaulding came to the Belchertown Police Department after seeing a news report of the delivery driver who had been robbed, according to court documents.
Fogg had been living with Spaulding for the last four months, Beaupre wrote.
Spaulding told police that on the night of the incident Fogg left the apartment for a short time.
When Fogg came back, he was wearing a mask and threw $5 and yelled “only five f—— dollars,” Beaupre wrote in the report.
Fogg is being held without the right to bail for 120 days after being deemed “dangerous” by Judge Michele Ouimet-Rooke.
