SUNDERLAND — A 29-year-old Deerfield man had a blood-alcohol level more than twice the legal limit and no license to operate a motorcycle when he was arrested during the weekend, according to police.
Jay P. Hardy of McClellan Farm Road was arraigned in Greenfield District Court on Tuesday on charges of operating while under the influence of alcohol, unlicensed operation of a motor vehicle and not having an inspection sticker.
According to a report by Sunderland police officer Jose Cabrera, Hardy was pulled over on his motorcycle Saturday evening after Cabrera noticed it traveling north on Amherst Road without an inspection decal. Hardy also had a passenger on the back, though a check with the Registry of Motor Vehicles showed he did not have a Class M license, which prohibits him from operating the motorcycle with passengers, as well as after dark, Cabrera reported.
After stopping the motorcycle and speaking with Hardy, Cabrera wrote that he immediately smelled an odor of alcohol coming from Hardy’s breath, and his speech was extremely slurred. According to the report, Hardy told police he had not consumed any alcohol that day, but a series of field sobriety tests indicated impairment and a preliminary breath test showed he had a blood-alcohol level of 0.181 percent.
He was placed under arrest and a chemical breath test during booking showed a result of 0.18 percent — more than twice the legal limit to drive of 0.08 percent.
Hardy was released on personal recognizance following his arraignment and is due back in court Nov. 4 for a pretrial conference.
