HADLEY — Hadley’s Zoning Board of Appeals is allowing a parking lot to be built on Route 9 that will be used by tenants at a new apartment complex in Amherst.

The board voted 3-0 on Tuesday to support a finding that the parking for the Aspen Heights residential community will be no more substantial or detrimental as a non-conforming accessory residential use at 408 Northampton Road than an existing swimming pool is for the Amherst Motel.

The decision comes as one piece of resolving a lawsuit over the project that required amended plans be remanded to boards in both Hadley and Amherst. The lawsuit was between Breck Group Amherst Massachusetts LP, which is developing the project, and attorneys representing seven residents who live at the neighboring Greenleaves Retirement Community.

Last month, the Amherst Zoning Board of Appeals approved several changes to the special permit it originally issued in November 2017.

Aspen Heights is expected to have 88 units and 192 beds in two-story buildings. Of the 240 spaces in the parking lot, 119 will be in Hadley and 121 will be in Amherst.
