SPRINGFIELD — The man accused of killing Amherst resident Andrew Musgrave outside of a Holyoke McDonald’s over the summer was arraigned in Hampden Superior Court last week.
Dennis I. Guzman, 20, of Holyoke, pleaded not guilty to one count of murder on Dec. 30 and was held without bail. Guzman was indicted on the charge on Dec. 6. Assistant Clerk Magistrate Brian Dolaher presided over Guzman’s arraignment.
According to a police report obtained through court records, Guzman is accused of fatally shooting Musgrave, 31, during a fight outside of the McDonald’s at 285 Maple St. on the night of Aug. 3. Witnesses told police they had heard Guzman arguing with Musgrave inside the restaurant before the incident.
Guzman was with his father, his uncle, and a friend on the night of the incident, police said. As the four were driving away from the McDonald’s and discussing what had just happened, Guzman’s father, Dennis Guzman Sr., speaking with Guzman’s uncle, Carlos Guzman, allegedly pointed to Guzman and said, “This one shot somebody,” according to court documents citing Guzman’s uncle. The gun was not recovered.
Guzman was arrested in North Philadelphia, Pennsylvania on Aug. 8 on a fugitive from justice warrant. He was subsequently held without the right to bail at his arraignment on Sept. 3 in Holyoke District Court, where he pleaded not guilty to charges of murder, assault and battery with a dangerous weapon and carrying a firearm without a license.
Musgrave was remembered by his family and friends as a charismatic, smart, inclusive and people-oriented person. Musgrave spent his formative years living in Amherst, where he graduated from Amherst Regional High School in 2006. After earning a business degree from the University of Miami in Florida, Musgrave became a journeyman carpenter with Local Union 157.
Guzman was represented at his arraignment by Northampton attorney Paul Rudof, who had not responded for comment by Tuesday morning. Assistant District Attorney Mary Sandstrom served as the prosecution. Guzman is due back in court for a pretrial hearing on July 20.
