NORTHAMPTON — A Hampshire County grand jury has indicted Steven J. Malloy on charges of murder and unlawful possession of a firearm in connection to a fatal shooting on Randolph Place last year.
Malloy, 32, pleaded not guilty to murder in Northampton District Court on Dec. 2 and remains held without bail. The indictment on Thursday elevated the case to Hampshire Superior Court, where a new arraignment date has not been set.
Joseph Fillio, 39, of Pittsfield, was found shot in the head inside a downtown Northampton apartment on the night of Dec. 1, 2021. He was pronounced dead at Baystate Medical Center in Springfield.
Police arrested Malloy, who is listed in court records as homeless, in the vicinity of West Street following a short search.
On Monday, Laurie Loisel, spokesperson for Northwestern District Attorney David Sullivan’s office, said prosecutors could not yet release details about the alleged motive for the shooting or any relationship between the two men. More information is expected to be released as the case moves through court.
The firearm charge against Malloy carries enhanced penalties because of two previous violent crime convictions.
Loisel said Malloy was convicted of assault and battery on a person with a disability in Springfield District Court in June 2010, and he was convicted of assault and battery and assault and battery with a dangerous weapon in Hampden County Superior Court in October 2013.
